The Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act, enacted in October 2008, requires group health insurance plans with 50 or more members to provide equal coverage of behavioral health and physical health. The law will go into effect for some insurance plans on October 3, 2009 and for calendar-year plans on January 1, 2010.
Despite this upcoming deadline, the U.S. Departments of Health and Human Services, Labor, and the Treasury have not yet issued regulations providing guidance to states and employers on the implementation of the Wellstone-Domenici parity law. To offer immediate assistance to employers in the meantime, the Psychologically Healthy Workplace Program has put together two documents to with answers to questions about mental health parity and suggestions for complying with the minimum requirements of the new law.
